Terms of Service

These Terms of Service (“Terms”) govern your use of FeedbaQR (the “Service”), operated by FeedbaQR, a DBA of South Fork Mobile LLC (“FeedbaQR,” “we,” “us”). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

FeedbaQR lets you create QR codes that drive a real-world interaction — collecting feedback, running a poll or vote, or hosting a guest book — along with hosted landing pages, printable artifacts, and a dashboard. The printed code stays stable while the destination it points to can change. We may add, change, or remove features over time.

You can build and test-drive a code without an account. Saving a code, editing it, printing it, or viewing analytics requires verifying your email through a one-time sign-in link — there is no password. You're responsible for the activity under your account and for keeping access to your email secure.

A code you build but never claim is a draft and may be deleted after roughly 30 days. You must be at least 13 years old (and old enough to form a binding contract) to create an account.

You agree not to use the Service to:

• break the law or infringe anyone's rights;
• submit fraudulent or automated votes/feedback, or otherwise manipulate results;
• collect personal data without a lawful basis, or harvest others' information;
• solicit or collect personal information from children under 13 — you choose what your code asks for, so you're responsible for COPPA and similar children's-privacy laws;
• post or link to unlawful, harmful, deceptive, or infringing content;
• interfere with, overload, or attempt to breach the Service.

We may suspend or remove codes or accounts that violate these Terms.

You keep ownership of the content and destinations you configure. You grant us a limited license to host, process, and display that content solely to operate the Service. You're responsible for your codes' destinations and for complying with the rules of any third-party platform you point to or integrate with.

In particular, if you route customers toward public reviews (e.g., Google or Yelp), you are responsible for following those platforms' review policies. Some platforms restrict selectively soliciting reviews (“review gating”) or incentivizing reviews; how you configure and promote your code is your decision and your responsibility.

Core features are free. Paid plans, where offered, are billed as described at the point of purchase and may be priced per event or per period; fees are processed by or on behalf of South Fork Mobile LLC. Unless required by law, fees are non-refundable.

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how we use it. In short: first-party, cookieless analytics; no advertising trackers; no selling of personal information; and we never store raw IP addresses. If you opt in to text (SMS) alerts, our SMS Terms also apply.

The Service is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law. We don't guarantee the Service will be uninterrupted, error-free, or that any result (scans, responses, votes) is accurate or complete.

To the maximum extent permitted by law, FeedbaQR and South Fork Mobile LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100.

You agree to indemnify and hold harmless FeedbaQR and South Fork Mobile LLC from claims and costs arising out of your content, your codes' destinations, or your misuse of the Service or violation of these Terms.

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Idaho have exclusive jurisdiction over any dispute, and you consent to venue there.

We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above and, where appropriate, communicated through the Service. Continued use after a change means you accept the updated Terms.
